1. Acceptance of Terms
By accessing and using the Tiquetes Monserrate website (hereinafter, "the Site"), operated by 125 Ventures LLC (domiciled in Sheridan, Wyoming, United States), and by making purchases through it, you accept these terms and conditions in their entirety. The processing of your personal data is described in our Privacy Policy. If you disagree with any part of these terms, please do not use our services.
2. Who We Are
Tiquetes Monserrate is a digital platform operated by 125 Ventures LLC, a limited liability company organized under the laws of the State of Wyoming, United States. Through the Site, users may purchase, in advance, tickets for access to Cerro de Monserrate, located in Bogotá, Colombia.
Tiquetes Monserrate is exclusively a digital intermediation platform for the advance acquisition of tickets. We do not operate the funicular, the cable car, or any facility or service at Cerro de Monserrate.
Our services include:
- Intermediation in the acquisition of tickets for the funicular and/or cable car at Cerro de Monserrate
- Digital ticket delivery via email
- Information on hours, access, and complementary services
3. Purchase Process
By making a purchase on the Site, you represent that:
- You are of legal age or have the authorization of a responsible adult
- The information you provide is truthful, accurate, and complete
- You are authorized to use the selected payment method
- You accept the price and conditions of the selected product
4. Prices and Payments
Prices are displayed in the currency selected by the user. Accepted payment methods include credit cards, debit cards, and other electronic payment methods enabled on the platform.
Prices may change without prior notice. However, once a purchase is confirmed, the price actually paid will be honored.
5. Ticket Delivery
Once payment is confirmed, tickets are delivered digitally by email to the registered address, typically within 15 minutes. If you do not receive your tickets within that timeframe, please check your spam folder and write to us at info@visitamonserrate.com so we can help.
Tickets are non-nominative: the QR code presented at the access point is sufficient for entry. Tickets may be transferred to another person for personal (non-commercial) use; commercial resale is prohibited.
It is the user's responsibility to verify that the contact information provided is correct. We are not responsible for non-receipt of tickets due to incorrect information or to the user's email provider's filters.
6. Cancellations, Changes, and Refunds
Cancellation and refund requests are evaluated according to the following reference conditions:
- Cancellations requested more than 48 hours before the planned visit date: up to 80% refund
- Cancellations requested 48 hours or less before the visit: non-refundable as a general rule
- If access to Cerro de Monserrate or the funicular/cable car services is affected by events of force majeure: rescheduling or a full refund, at the user's choice
Notwithstanding the above, Tiquetes Monserrate may offer additional accommodations at its discretion to ensure customer satisfaction. For any request, please write to us at info@visitamonserrate.com.
In addition, consumers resident in Colombia are entitled to exercise the right of withdrawal (retracto) within five (5) business days from the date of purchase, in accordance with Article 47 of Law 1480 of 2011, provided that the ticket has not been used. To exercise this right, please write to us at info@visitamonserrate.com indicating the order and your intent to withdraw; we will refund the amount paid by the means and within the timeframes provided by applicable law.
7. Use of the Service at Cerro de Monserrate
During your visit to Cerro de Monserrate, you must:
- Present a valid ticket in digital or printed format upon entry
- Respect the operating hours, capacity limits, and rules in force at the site
- Follow the instructions of the site's operations and security staff
- Take care of the facilities, cultural heritage, and natural surroundings of Cerro de Monserrate
- Refrain from activities that endanger your safety or the safety of other visitors
Entry to Cerro de Monserrate is subject to the right of admission in force at the site, and may be denied to visitors who do not comply with the rules of the place.
8. Customer Service and Limitation of Liability
Tiquetes Monserrate handles customer service directly for any question, concern, or claim related to purchases made through the Site. If something does not turn out as expected — before, during, or after your visit — please write to us at info@visitamonserrate.com. We will work with you to find a solution.
Tiquetes Monserrate is a digital intermediation platform for the acquisition of tickets and does not operate the funicular, the cable car, or any other facility or service at Cerro de Monserrate. The conditions of the visit — operating hours, service availability, and access rules — may change without prior notice and are outside the control of Tiquetes Monserrate.
The total liability of 125 Ventures LLC to the user for any claim related to the Site or to tickets purchased through it shall not exceed the amount actually paid by the user for such tickets.
9. Intellectual Property and Trademarks
All content on the Site, including text, design, graphics, the Site's logos, code, and original editorial materials, is the property of 125 Ventures LLC or its licensors and is protected by applicable intellectual property laws. Its reproduction, distribution, or commercial use without prior written authorization is prohibited.
The name "Cerro de Monserrate" and other trademarks, names, or distinctive signs associated with it are the property of their respective owners. Their use on this Site is solely descriptive, to identify the destination to which the offered tickets refer, and Tiquetes Monserrate claims no rights over them.
10. Modifications to the Terms
We reserve the right to modify these terms and conditions at any time. Modifications take effect upon their publication on the Site. Continued use of the Site after a modification is published constitutes acceptance of the modified terms.
11. Governing Law and Venue
These terms and conditions are governed by and construed in accordance with the laws of the State of Wyoming, United States of America, without regard to its conflict-of-laws rules. Subject to the arbitration clause below, any dispute not subject to arbitration shall be brought exclusively in the state courts located in Sheridan County, Wyoming, or in the United States District Court for the District of Wyoming, and the parties irrevocably submit to the personal jurisdiction of such courts.
12. Arbitration and Class-Action Waiver
Any dispute, claim, or controversy arising out of or relating to these terms, the Site, or tickets purchased through the Site, including its validity, performance, or interpretation, shall be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and not through a court proceeding, except: (i) either party may bring an individual claim in a small-claims court of competent jurisdiction, if the claim qualifies for such forum; and (ii) either party may seek injunctive relief to protect intellectual property rights.
Jury trial and class-action waiver: the user and 125 Ventures LLC waive any right to a trial by jury and agree that any dispute shall be resolved only on an individual basis and NOT in a class, consolidated, or representative action. If this class-action waiver is found unenforceable, this entire arbitration clause shall be null and void.
This clause does not deprive the user of any rights granted by mandatory law of the user's jurisdiction of residence that cannot be waived contractually. In particular, consumers resident in Colombia may, in addition, present their complaints before the Superintendencia de Industria y Comercio (SIC) at www.sic.gov.co as a pre-judicial consumer-protection step.
13. Severability
If any provision of these terms is held invalid or unenforceable under applicable law, such provision shall be interpreted to the greatest extent permitted or, if that is not possible, shall be deemed severable; the remaining provisions shall remain in full force and effect.
